Welcome to Magdalene’s Project.

These Terms and Conditions apply to the use of our website, magdalenesproject.com, and to all purchases made through our webshop. By accessing our website, placing an order, or purchasing a product from us, you agree to these Terms and Conditions.

Please read them carefully before placing an order.

1. ABOUT US

Magdalene’s Project is a community-based project offering handcrafted garments and accessories, including T-shirts, caps, bags, and other handmade products.

2. OUR PRODUCTS

We sell handcrafted garments and accessories, including but not limited to:

  • T-shirts;
  • Caps;
  • Bags;
  • Handmade garments;
  • Handcrafted accessories; and
  • Other products displayed on our webshop.

Because many of our products are handmade or handcrafted, slight variations in colour, stitching, size, pattern, placement, or finishing may occur. These small differences are part of the unique character of handmade products and are not necessarily considered defects.

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizes, and prices displayed on our website are accurate. However, the actual colour of a product may appear slightly different depending on the customer’s screen or device settings.

3. ORDERS

An order is considered a request to purchase products from Magdalene’s Project.

After receiving an order, we may contact the customer to confirm:

  • Product availability;
  • Size, colour, or design selection;
  • Delivery or collection arrangements;
  • Payment method; and
  • Any other information necessary to complete the order.

We reserve the right to decline or cancel an order if a product is unavailable, if incorrect information has been provided, or if we are unable to fulfil the order for a reasonable cause.

If an order cannot be fulfilled, the customer will be informed as soon as reasonably possible.

4. PRICES

All prices are displayed in Namibian Dollars (NAD/N$), unless otherwise stated.

The price shown at the time an order is placed will apply to that order, subject to correction of any obvious pricing or technical error.

Any delivery charges, where applicable, will be communicated to the customer before the order is completed.

5. PAYMENT

Payment may be made by:

  • Cash on delivery; or
  • Direct bank transfer on delivery or as otherwise agreed with the customer.

For direct bank transfers, the order will only be considered fully paid once the payment has been received and confirmed in our bank account.

Customers must use the correct order reference or other payment reference provided by Magdalene’s Project when making a bank transfer.

We will never be responsible for payments made to incorrect bank details that were not officially provided by Magdalene’s Project.

6. DELIVERY AND COLLECTION

Delivery arrangements will depend on the customer’s location and the delivery options available at the time of the order.

Where delivery is available, the customer must provide a complete and accurate delivery address and contact details.

Estimated delivery times are provided in good faith. Delays may occasionally occur due to circumstances outside our reasonable control.

Where collection is agreed upon, customers may collect their orders from the agreed location and at the agreed time.

7. RETURNS

We want our customers to be happy with their purchases.

Customers may request to return an eligible product within 14 calendar days of receiving the product.

To qualify for a return, the product should:

  • Be unused and unworn;
  • Be in its original condition;
  • Not have been washed, altered, damaged, or stained after delivery;
  • Have any original tags or packaging, where applicable; and
  • Be accompanied by proof of purchase or order confirmation.

Before returning a product, the customer should contact Magdalene’s Project and provide the order details and the reason for the return.

Unless the product is defective, damaged upon delivery, or incorrect, the customer may be responsible for the reasonable cost of returning the product.

8. NON-RETURNABLE ITEMS

For hygiene, safety, and practical reasons, certain products may not be eligible for return, including:

  • Products that have been worn or washed;
  • Products damaged after delivery through misuse or improper care;
  • Personalised or custom-made products created specifically for the customer, except where defective or incorrectly supplied; and
  • Any other products that cannot reasonably be resold for hygiene reasons.

This section does not limit any rights that a customer may have under applicable law in relation to defective, damaged, or incorrectly supplied products.

9. DEFECTIVE, DAMAGED, OR INCORRECT PRODUCTS

If a customer receives a product that is defective, damaged, or different from the product ordered, the customer should contact Magdalene’s Project as soon as reasonably possible.

We may request:

  • The order number;
  • A description of the problem; and
  • Photographs showing the defect, damage, or incorrect item.

After reviewing the matter, we may offer an appropriate solution, including replacement, exchange, repair where appropriate, or refund.

10. REFUNDS

Where a refund is approved, the refund will normally be made using an agreed method appropriate to the original payment method.

For cash payments, the refund may be made in cash or by bank transfer, as agreed with the customer.

For direct bank transfer payments, the refund will normally be made by bank transfer to the customer.

Refunds will be processed within a reasonable period after the returned product has been received and inspected.

11. CANCELLATION OF ORDERS

Customers should contact us as soon as possible if they wish to cancel an order.

If production of a personalised or custom-made item has already started, cancellation may not be possible, subject to applicable law.

For standard products, cancellation requests will be considered based on whether the order has already been prepared, dispatched, delivered, or collected.

12. CARE OF PRODUCTS

Customers are responsible for following any washing, cleaning, and care instructions provided with the product.

Magdalene’s Project will not be responsible for damage caused by:

  • Incorrect washing or drying;
  • Use of unsuitable cleaning products;
  • Bleaching where not recommended;
  • Improper ironing;
  • Normal wear and tear; or
  • Misuse of the product.

13. WEBSITE USE

Customers agree to use our website only for lawful purposes.

Users must not:

  • Attempt to interfere with the operation or security of the website;
  • Submit false or misleading information;
  • Place fraudulent orders;
  • Copy or misuse website content without permission; or
  • Use the website in a way that may harm Magdalene’s Project or other users.

14. INTELLECTUAL PROPERTY

Unless otherwise stated, the content of magdalenesproject.com, including its name, logo, product photographs, designs, written content, graphics, and other original material, belongs to Magdalene’s Project or is used with permission.

Such content may not be copied, reproduced, distributed, or used commercially without prior written permission.

15. PERSONAL INFORMATION

We may collect personal information that is reasonably necessary to process and fulfil orders, communicate with customers, arrange delivery or collection, process payments, and provide customer support.

We will take reasonable steps to protect personal information and will not sell customer information to third parties.

Customer information may be shared with service providers only where reasonably necessary to process an order, arrange delivery, operate the webshop, or comply with legal obligations.

16. LIMITATION OF LIABILITY

To the extent permitted by applicable law, Magdalene’s Project will not be responsible for indirect or consequential losses arising from the use of the website or products.

Nothing in these Terms and Conditions is intended to exclude or limit any liability or consumer right that cannot legally be excluded or limited under the laws of Namibia.

17. CHANGES TO THESE TERMS

We may update these Terms and Conditions from time to time.

The latest version will be published on magdalenesproject.com together with the date of the most recent update.

The Terms and Conditions in effect at the time an order is placed will generally apply to that order.

18. GOVERNING LAW

These Terms and Conditions are governed by the laws of the Republic of Namibia.

Any dispute arising from the use of the website or the purchase of products will be handled in accordance with the applicable laws of Namibia.
